رخصة البناء وشهادة المطابقة كأليتين لتنظيم التهيئة العمرانية في التشريع الجزائري

Résumé: الملخص: لقد خصص المشرع الجزائري مجموعة من النصوص القانونية المتعلقة بالبناء, المطابقة والتهيئة العمرانية, لتنظيم حركة البناء. وبغية الوصول إلى هذه الغاية قيد القيام بمختلف أشغال البناء بضرورة الحصول على تراخيص إدارية أهمها: رخصة البناء وشهادة المطابقة العادية. لكن هذه الترسانة القانونية لم تثبت فعاليتها. خاصة خلال العشرية السوداء التي عرفت انتشار رهيب لظاهرة البنايات غير المتممة وغير المطابقة للأحكام القانونية. ولذلك ظهرت الحاجة إلى المعالجة التشريعية لإيجاد الحلول المناسبة مع تحسيس المواطنين بأهمية المجال العمراني لإنجاح عملية إتمامها ومطابقتها. وهذا ما تجسد فعلاً من خلال إصدار القانون رقم 08-15 المحدد لقواعد مطابقة البنايات وإتمام إنجازها, وأهم ماجاء به هو تسوية البناية غير القانونية عن طريق تسليم لصاحبها شهادة المطابقة الاستثنائية. الكلمات المفتاحية: رخصة البناء، شهادة المطابقة العادية، شهادة المطابقة الاستثنائية، التهيئة العمرانية. Résumé : Le législateur algérien a précisé un ensemble des textes juridiques relatifs à la construction, à la conformité et à l'aménagement d’urbanisme, afin de réglementer le mouvement de la construction. Pour atteindre ce but, les différents travaux de construction sont soumis à la nécessité d'obtenir des permis administratives, dont les plus importantes sont le permis de construire et le certificat normale de conformité. Mais cet arsenal juridique ne s'est pas révélé efficace. Surtout pendant la décennie noire, qui a été une terrible propagation du phénomène des bâtiments incomplets et non conformes aux dispositions légales. Par conséquent, un traitement législatif est nécessaire pour trouver les solutions appropriées, tout en sensibilisant les citoyens à l'importance de le domaine urbain et pour le succès du processus d'achèvement et de conformité. La loi N ° 08-15, qui énonce les règles relatives à la conformité et à l'achèvement des bâtiments, a pris des mesures à cet effet, le plus important étant de régler le bâtiment illégal en remettant à son propriétaire le certificat de conformité exceptionnelle. Abstract : The Algerian legislator has specified a set of legal texts relating to construction, compliance and urbanization planning, in order to regulate the movement of construction. To achieve this goal, the various construction works are subject to the need to obtain administratives permits , the most important of which are the building permit and the normale certificate of conformity. But this legal arsenal has not proved effective. Especially during the black decade, this was a terrible propagation of the phenomenon of incomplete buildings and not in accordance with legal provisions.Therefore, legislative treatment is needed to find appropriate solutions, while raising citizens' awareness of the importance of urban filed and the success of the completion and compliance process. Law No 08-15, which sets out the rules for the conformity and completion of buildings, has taken measures to this end, the most important of which is to regulate the illegal buildings by giving the owner the exceptional certificate of conformity.
