Résumé: سنعالج في هذا المقال موضوع الوساطة الجزائية كبديل للدعوى العمومية من حيث أحكامها، فبدل المضي في الدعوى العمومية كوسيلة للعدالة العقابية، استحدثت التشريعات الجنائية الحديثة نظم بديلة للدعوى العمومية قائمة على التراضي والملائمة، من أهمها الوساطة الجزائية والتي تبنتها بعض التشريعات الجنائية كالتشريع الفرنسي والجزائري نظرا لدورها البارز في تحقيق مصلحة المجتمع ومصلحتي الجاني والمجني عليه. In this article, we will deal with the issue of criminal mediation as an alternative to the public case in terms of its provisions, instead of proceeding with the public case as a method of punitive justice , modern criminal legislation has introduced alternative systems of public litigation based on consent and appropriateness, Among the most important of them is the criminal mediation adopted by some criminal legislation , such as the French and Algerian legislation , given its prominent role in achieving the interest of society and the interests of the perpetrator and the victim.
