استحقاق الحضانة في القانون الجزائري

Résumé: بعدما كان المشرع الأسري الجزائري في قانون11/84 يتوافق مع اتجاه الفقه المالكي في ترتيب مستحقي الحضانة، خرج عن الاتجاه العام في الفقه الإسلامي بموجب الأمر 05/02، مما عده البعض خروجا على أحكام الشريعة الإسلامية في هذه الجزئية، غير أن الأمر ليس كذلك، إذ هي ذاتها فتحت الباب على مصراعيه للاجتهاد فيما لا نص فيه، كما هو في هذه الحالة، حيث أخضعت ترتيب مستحقي الحضانة لمبدأ مصلحة المحضون، وهذا الذي راعاه المشرع الجزائري بموجب المادة 64 من قانون الأسرة، وضمانا لحماية مصلحة المحضون، خول المشرع الجزائري مهمة كشفها للسلطة التقديرية للقاضي، كما جرم الامتناع عن تسليم المحضون لمستحقه الشرعي وعاقب عليه باعتباره جنحة. After the Algerian family legislator in Law 11/84 was consistent with the direction of the Maliki jurisprudence in arranging those entitled to custody, he departed from the general trend in Islamic jurisprudence by virtue of Order 05/02, which some considered as a departure from the provisions of Islamic Sharia in this part, but this is not the case, As she herself opened the door wide for diligence in what is not stipulated, as it is in this case, where she subjected the arrangement of those entitled to custody to the principle of the child’s interest, and this was taken into account by the Algerian legislator under Article 64 of the Family Code, and in order to ensure the protection of the interests of the child in custody, the Algerian legislator was authorized the task of revealing it At the discretion of the judge, it also criminalized refusal to deliver the child in custody to his legal right and punished him as a misdemeanour
