Résumé: ملخص: أدى انتشار وباء كورونا (كوفيد- 19) في الجزائر إلى تأثيره على العلاقات التعاقدية خصوصا عقب صدور المرسوم20-69 المؤرخ 21 مارس2020 المتعلق بتدابير الوقاية من انتشار وباء كورونا (كوفيد-19 ) ومكافحته، حيث اقر حزمة من التدابير الوقائية جعل المتعاقد مع الإدارة في وضعية الإخلال بالالتزامات التعاقدية، في ظل هذا الوضع وللتخفيف من آثار التدابير الوقائية اتخذت الحكومة الجزائرية تدابير مؤقتة اعتبرت وباء (كوفيد- 19) قوة قاهرة يعفي المتعاقد مع الإدارة من دفع غرامة التأخير، إلا أن هذه التدابير غير فعالة مما يستدعي البحث آليات قانونية تحقق الموازنة بين مصلحة الإدارة المتعاقدة من جهة ومصلحة المتعاقد معها من جهة أخرى. من أجل الوقوف على ذلك ينبغي بحث الحلول القانونية للأثر القانوني (لكوفيد- 19) على غرامة التأخير في مجال الصفقات العمومية في القانون الجزائري . Abstract: The spread of the Corona (Covid-19) epidemic in Algeria has resulted in its impact on contractual relations, in particular after the publication of Decree 20-69 of March 21, 2020 relating to measures to prevent and fight against the spread of the Corona epidemic (Covid-19). A situation of breach of contractual obligations, in light of this situation and to mitigate the effects of preventive measures, the Algerian government has taken temporary measures considering the epidemic (Covid-19) as a case of force majeure which exempts the contracting with the administration of the late payment of the fine, but these measures are ineffective, requiring research into the legal mechanisms for achieving the budget. Show the interest of the contracting authority on the one hand and the interest of the contractor on the other. To find out, we must discuss the legal solutions to the legal impact (of Covid-19) on the late payment fine in the field of public procurement under Algerian law
