ولاية الأم على مال القاصر بين الإطلاق والتقييد

Résumé: ملخص باللغة العربية : تهدف هذه الدراسة إلى إبراز حدود ولاية الأم على مال القاصر والوقوف على أهم الإشكالات التي تثيرها. حيث توصلنا إلى أنّ المشرع الجزائري استحدث من خلال تعديله قانون الأسرة سنة 2005 مكسبا هاما للأم في مجال الولاية، إلا أنّها لا تزال تواجه صعوبات في ممارستها وهذا راجع إلى الغموض والنقص الذي شاب بعض النصوص القانونية . ملخص باللغة الإنجليزية: This study aims to highlight the limits of the mother's guardianship over minor's property and to identify the major problems this can generate. We concluded that despite the advantage of guardianship established for the mother by the Algerian legislature when amending the family code in 2005, the latter still faces difficulties, and this is due to the ambiguity and lack of legal provisions
