الظروف الطارئة و أثرها على بيع السلم -دراسة تأصيلية تطبيقية

Résumé: " الملخص يتناول هذا البحث دراسة الظروف الطارئة وبيع السَّلَم في الفقه الإسلامي، ويهدف إلى تأصيل أثر الظروف الطارئة على بيع السَّلَم؛ وذلك من خلال تطبيق نظرية الظروف الطارئة على بيع السَّلَم في ظل نموذجين للظروف الطارئة هما: تغير قيمة العملة وجائحة مرض فيروس كورونا 19، وتوصل في الأخير إلى أن تأثير الظروف الطارئة على بيع السَّلَم له ثلاث صور، وهي: الصورة الأولى تعديل عقد السَّلَم، وذلك في حالتين: الأولى تغير قيمة العملة والثانية في بعض حالات جائحة كورونا التي يكفي فيها تعديل العقد لإزالة الضرر الناشئ عنها، والصورة الثانية فسخ عقد السَّلَم، وذلك في حالات جائحة كورونا التي لا يزال الضرر الناشئ عنها إلا بفسخ العقد ويشترط مع ذلك ألا يكون الضرر بسبب مانعا شرعيا، أما إن كان سبب الضرر مانعا شرعيا، فإن عقد السَّلَم ينفسخ بحكم الشرع وهذه هي الصورة الأخيرة.
