ضمانات المراقبة الالكترونية في التشريع الجزائري

Résumé: ملخص: تهدف هده الدراسة الى التطرق للضمانات الموضوعية والشكلية للمراقبة الإلكترونية أو ما يسمى اعتراض المراسلات وتسجيل الأصوات والتقاط الصور باعتبارها من الأساليب الخاصة للتحري والتحقيق في الإجرام المنظم وتبين هذه الدراسة الطبيعة القانونية لاعتراض المراسلات والحق في الصورة وأهم الشروط التي وضعها المشرع الجزائري لتقوية وضمان حماية حرمة الحياة الخاصة . الكلمات الدالة : الضمانات القانونية؛ اعتراض المراسلات؛ تسجيل الأصوات؛ التقاط الصور. Summary: This study aims to address the objective and formal guarantees and the legitimacy of electronic surveillance or the so-called interception of correspondence, voice recording and photo taking as one of the special methods of investigation and investigation of organized crime. This study shows the legal nature of the interception of correspondence, image rights and the most important conditions set by the Algerian legislator to strengthen and ensure the protection of the sanctity of private life.
