النظام القانوني للمكتب الدائم للمجلس الأعلى للقضاء الجزائري

Résumé: تَهدفُ هذه الدراسة إلى تسليط الضوء على المكتب الدائم باعتباره أحد أجهزة المجلس الأعلى للقضاء الجزائري إلى جانب أمانة المجلس وهياكله الإدارية ، وتَدْرُسُ نشأتَه وتطورَه التاريخي ودورَه في تعزيز استقلالية المجلس أو مصادرتها شهد القانون رقم 98-21 ميلاد المكتب الدائم – كجهاز ثانٍ إلى جانب كتابة المجلس ، لكنه سرعان ما أُلغي بموجب المرسوم التشريعي رقم 92-05 ، ليُعادَ بَعْثُهُ إلى الحياة من جديد بموجب القانون العضوي رقم 04-11ولكن بشكل باهت ضعيف وتحت سُلطة وزير العدل ومنافسة الأمانة العامة للمجلس ، ليَظهر في مرحلة تالية في ظل القانون العضوي رقم 22-12 بشكل أكثر قوة واستقلالية بعد تحرره من قبضة وزير العدل وقَصْرِ تأليفهِ على أعضاء المجلس القضاة المنتخبين وتوسيع صلاحياته. This study aims to shed light on the Permanent Office as one of the organs of the Algerian Supreme Judicial Council, alongside the Council’s secretariat and its administrative structures, and studies its origins, historical development, and role in strengthening or confiscating the Council’s independence. Law No. 98-21 witnessed the birth of the Permanent Office - as a second body alongside the Council’s office. But it was quickly canceled under Legislative Decree No. 92-05, only to be revived again under Organic Law No. 04-11, but in a weak and faded form and under the authority of the Minister of Justice and in competition with the Secretariat of the Council, to appear at a later stage under Organic Law No. 22-12. In a more powerful and independent manner after it was liberated from the control of the Minister of Justice, limiting its composition to the elected judges of the Council, and expanding its powers.
