أثر التغيرات الاجتماعية المعاصرة على القوامة في الفقه وقانون الأسرة الجزائري

Résumé: تميز عصرنا الحالي بتغيرات جذرية في كافة مجالات الحياة، التي أثرت على المجتمعات بصفة عامة والأسرة وأفرادها بصفة خاصة، من بين تلك التغيرات الاجتماعية التي أحدثت تغيرا للأدوار في الأسرة وانحسار القوامة عند بعض الأسر، لتكون بدلها الشراكة الزوجية في تسيير شؤون الأسرة، وهذا راجع لعدة عوامل منها استقلال المرأة علميا وماديا، وانسحاب الأزواج عن مهامهم الزوجية والأبوية، وكذلك للدعوات الغربية من بعض الهيئات والاتفاقيات الدولية، بحجة تغير الحال ينبغي أن تتغير المفاهيم والقوانين لتساير الوضع. يتطرق البحث إلى تعريف القوامة بصفة عامة قديما وحديثا ومدى تأثرها بالوضع الحالي، وموقف الفقه وقانون الأسرة الجزائري Our current era was distinguished by radical changes in all areas of life, which affected societies in general and the family and their members in particular, among those social changes that have changed the roles in the family and the decline of guardianship among some families, so that their marital partnership in the conduct of family affairs, and this is due to several Factors, including the independence of women scientifically and financially, and the withdrawal of husbands from their marital and parental tasks, as well as for Western calls from some international bodies and agreements, on the pretext of changing the situation, concepts and laws should change to facilitate the situation. The research addresses the definition of stewardship in general in the past and in the past and the extent of its influence on the current situation, the position of jurisprudence and the Algerian family law
