مؤسسة الاجتهاد الدستوري في الجزائر في ظل التعديل الدستوري نوفمبر2020 - قراءة في عضوية التشكيلة –

Résumé: الملخص: يهدف المقال إلى قراءة في عضوية تشكيلة مؤسسة الاجتهاد الدستوري في ظل التعديل الجديد 2020، وبحث مدى إرساء المؤسس الدستوري لضمان الاستقلالية والحيادية والنزاهة داخل المؤسسة. وتم التوصل إلى أن المؤسس الدستوري وُفق لحدٍّ ما لإرساء وتحقيق ذلك من خلال استحداث شروط في عضوية التشكيلة؛ تسهم في إبعاد أي تأثيرات خارجية على الآراء والقرارات التي يتخذها أعضاء مؤسسة الاجتهاد الدستوري، ولكن لتكتمل هذه الاستقلالية يتم التأكيد على ضرورة تفعيل بعض الاقتراحات التي تم التوصل إليها على ضوء جملة من النتائج. الكلمات المفتاحية: مؤسسة الاجتهاد الدستوري، التعديل الدستوري 2020، التشكيلة، شروط العضوية. Abstract: The article aims to examine the membership structure of the Constitutional Jurisprudence Institution in light of the new 2020 amendment, and to explore the extent to which the constitutional founder has established independence, neutrality, and integrity within the institution. It has been concluded that the constitutional founder has somewhat succeeded in establishing and achieving this through introducing conditions for membership in the structure, which contribute to distancing any external influences on the opinions and decisions made by members of the Constitutional Jurisprudence Institution. However, for this independence to be complete, emphasis is placed on the necessity of implementing some of the suggestions that have been reached based on a set of findings.
