الاستجواب البرلماني كأداة رقابية فعّالة في ظل التعديل الدستوري الجزائري لسنة 2020

Résumé: الملخص: يعد الاستجواب البرلماني في ظل التعديل الدستوري لسنة 2020 وسيلة رقابية مهمة وفعالة في تحريك المسؤولية السياسية للحكومة، حيث يمكن أن يترتب عنه حجب الثقة عنها وإسقاطها من خلال إمكانية تحريك ملتمس الرقابة، وبذلك أصبح بإمكان نواب المجلس الشعبي الوطني إثارة مسؤولية الحكومة من خلال توقيع ملتمس الرقابة في مناسبتين، الأولى بعد مناقشة بيان السياسة العامة، والثانية على إثر الاستجواب البرلماني. لكن على الرغم من إيجابية نطاق استخدام ملتمس الرقابة ليطال الحكومة كأثر للاستجواب، إلا أن الإبقاء عليه بذات الضوابط والقيود التعجيزية السابقة جعلت منه إجراء صعب التطبيق واقعيا. Abstract: Questions to Parliament under the 2020 Constitutional Amendment is an important and effective oversight tool to guide the government’s political accountability, which could lead to a lack of trust and loss of confidence through the possibility of triggering censorship of petitioners, The deputies of the National People’s Cangress could thus raise the accountability of the Government by signing the petitioner for the oversight of the policy statement and parliamentary questioning twice. However, despite the positive scope of the petitioner’s use censorship to reach the government as an impact of the interrogation, the maintenance with the same precautionary controls and restrictions as before made it realistically difficult to implement.
