إسهامات الوقف في التنمية بالنظر إلى الشخصية الاعتبارية

Résumé: ملخص: يعدّ المال عنصرا أساسيا في بناء حياة المجتمع، لأنه وسيلة لإشباع الحاجيات إذا تمّ تداوله بالطرق المشروعة. وعليه فإن الأصل في المال أن يكون قابلا للتداول بين الناس بكل التصرفات، ولكن في بعض الحالات لا يمكن تداول الأموال إذا أصبحت محبوسة (وقفا) على جهة معينة للانتفاع بريعها على وجه التأبيد والاستمرارية، ولكن يمكن نماء ريع هذه الأموال. وقد عرف الوقف سابقا على الأموال العقارية التي كانت تقتصر على دور العبادة، ولكنها توسعت إلى أغراض اجتماعية واقتصادية من أجل تحسين الوضعية الاجتماعية للفقراء والمساكين وابن السبيل ... إن الوقف يتمتع بالشخصية الاعتبارية، وهي التي أكسبت المال الموقوف اعتبارا حيث أنه يعدّ عاملا من عوامل الإنتاج، واهتم به المسلمون وفقا لهذا الاعتبار، حيث أنه يؤدي إلى القضاء على البطالة وعلى التخلف ويقف خادما للمجتمع ومساعدا له على أداء بعض العبادات وتوفير خدمات صحية وتعليمية، وهذا دون الرجوع والنظر إلى الواقف. كما أن تمتع المال الوقفي بالشخصية الاعتبارية يساهم في المحافظة على هذا المال في حدّ ذاته واستمراره وتطوره وهي أمور مختلفة عن بعضها البعض تجمعها الشخصية الاعتبارية. وقد نص المشرع الجزائري على الوقف ضمن قانون الأسرة (1984) وبعدها أفرده بقانون خاص هو القانون رقم 91/10 المؤرخ في 27/04/1991 وتلته مراسيم. Abstract: Money is an essential element in building the life of society, because it is a means of satisfying needs if it is traded in legitimate ways. Thus, the origin of the money can be negotiable among people in all ways, but in some cases, money can not be traded if it is held in a certain place to use its profits in the face of persistence and continuity, but it is possible to develop the proceeds of these funds. The Waqf was previously known for real estate funds, which were limited to houses of worship, but expanded to social and economic purposes in order to improve the social status of the poor, the poor and the wayfarer. The waqf has the legal personality, and it is the one who earned the suspended money as it is considered a factor of production. The Muslims are concerned with this consideration, as it leads to the elimination of unemployment and underdevelopment and serves as a servant of society and helps him to perform certain acts of worship. And provide health and educational services, and this without reference and look at the stander. And the enjoyment of money endowment legal person contributes to the preservation of this money in itself and its continuation and development are different from each other and their legal personality. The Algerian legislator provided for the waqf within the Family Law (1984) and was subsequently privatized by a special law, Law No. 91/10 of 27/04/1991 followed by decrees.
