الحق في الحياة بين المواثيق الدولية لحقوق الإنسان ومقاصد الشريعة الإسلامية

Résumé: يعد الحق في الحياة من أهم وأجل حقوق الإنسان، حيث نصت عليه مختلف المواثيق الدولية لحقوق الإنسان واعتبرته حقا أساسيا لا يمكن التعدي عليه أو المساس به، كالإعلان العالمي لحقوق الإنسان (1948) والعهد الدولي للحقوق المدنية والسياسية(1966) وغيرهما. بيد أن الشريعة الإسلامية الغراء كانت الأسبق في هذا المجال، فقد أولت هذا الحق عناية خاصة واهتماما بالغا، إذ جعلته مقصدا ضروريا من مقاصدها "حفظ النفس"، وشددت على ضرورة صونه وحمايته، كونه يرتبط بالإنسان الذي يعد محور الوجود وخليفة الله في أرضه. وعليه فسيتم التركيز في هذه الدراسة على إبراز مفهوم الحق في الحياة (حفظ النفس) وتبيان ضمانات وأساليب حمايته بين نصوص المواثيق الدولية لحقوق الإنسان ومقاصد الشريعة الإسلامية. Right to Life is considred the most important rights among Human Rights, and that is provided in various International Instruments, they consider it fundamental rights that cannot be infringed or compromised among those instruments, The Universal Declaration of Human Rights (1948) and International Covenant on Civil and Political Rights (1966). Islamic Law was a former one in this field in which it has given the right to life a special care and attention. It made this right a necessary purpose « Self-Preservation », it stressed its protection and maintenance. The focus in this study will be on highlighting the concept of Right to Life « Self-Preservation » and demonstrating safeguards and methods of its protection as provided for in International Human Right Instruments and the purposes of Islamic Law.
