المحكمة الدولية لقانون البحار ومدى إمكانية النظر في النزاعات البحرية الجزائرية

Résumé: الملخص: تعتبر المحكمة الدولية لقانون البحار إحدى أجهزة القضاء الدولي المتخصص و التي تفصل في نوع واحد من النزاعات وهي تلك المتعلقة بتطبيق وتفسير اتفاقية الامم المتحدة لقانون البحار لسنة 1982 وما قد ينشأ عنها من نزاعات، لذا تم البحث في تكوبن هذه المحكمة واختصاصاتها وكيفية الفصل في النزاعات التي تعرض أمامها مع دراسة أمثلة تطبيقية لنزاعات سبق وأن فصلت المحكمة فيها، وبعد تحديد الجزائر لإحدى المناطق من مجالها البحري عام 2018 وهي المنطقة الاقتصادية الخالصة، بطريقة لم تعجب الدول المقابلة للسواحل الجزائرية، طفا على السطح بوادر نزاع بحري بين الجزائر وكل من إسبانيا وإيطاليا بخصوص حدود هذه المنطقة. تبحث هذه الدراسة في حيثيات هذا النزاع ومستقبله ومدى امكانية نظر وفصل المحكمة الدولية لقانون البحار في مثل هذا النزاع. الكلمات المفتاحية: محكمة الدولية لقانون البحار، قضاء الدولي متخصص،منازعات قانون البحار، نزاع بحري جزائري إسباني، نزاع بحري جزائري إيطالي. résumé Le Tribunal international du droit de la mer est considéré comme l'un des organes judiciaires internationaux spécialisés, qui règle un type de différends, qui sont ceux liés à l'application et à l'interprétation de la Convention des Nations Unies sur le droit de la mer de 1982 et aux conflits qui peuvent en découler. Devant elle, avec une étude d'exemples pratiques de litiges dans lesquels le tribunal s'était précédemment séparé, et après la détermination par l'Algérie de son domaine maritime en 2018, en particulier la zone économique exclusive, il est apparu à la surface des signes d'un différend maritime entre l'Algérie et l'Espagne et l'Italie concernant les frontières de cette région. Cette étude examine les causes et l'avenir de ce conflit et la mesure dans laquelle le Tribunal international du droit de la mer peut examiner et juger un tel différend. Abstract The International Tribunal for the Law of the Sea is considered one of the specialized international judicial bodies, which settles in one type of disputes, which are those related to the application and interpretation of the United Nations Convention on the Law of the Sea of 1982 and the conflicts that may arise from it. In front of her, with a study of practical examples of disputes in which the court had previously separated, and after Algeria's determination of its maritime field in 2018, especially the exclusive economic zone, it appeared on the surface signs of a maritime dispute between Algeria and Spain and Italy regarding the borders of this region. This study examines the causes and future of this conflict and the extent to which the International Tribunal for the Law of the Sea can be considered and adjudicated in such a conflict.
