أحكام الشيوع الإجباري في التشريع الجزائري

Résumé: إن بقاء المال في حالة شيوع، ومنع الشركاء من المطالبة بقسمته، على ما يتطلبه وضع "الشيوع الإجباري"، يقتضي تنظيم حق الشركاء في التمتع بهذا المال، تفاديا لحدوث أي خلاف أو نزاع بين الشركاء فيما يتعلق بمباشرة كل واحد منهم لسلطاته و استيفائه لحقوقه في العين المشتركة. ويهدف هذا البحث إلى بيان الأحكام المتعلقة بشؤون الشيوع الاجباري التي نظمها القانون المدني الجزائري والمتمثلة في: "الأجزاء المشتركة في ملكية الطبقات" ، و "الحائط المشترك". وعلى هذا الأساس تم تقسيم البحث إلى فصلين، تناولنا الأول منها مفهوم الشيوع الإجباري من خلال تبيان معناه وكذا صوره، أما الثاني تناولنا أحكام الشيوع الاجباري، فخصصنا المبحث الاول عن إدارة الاجزاء المشتركة في ملكية الطبقات، فقد نظم المشرع كيفية إدارتها في المواد من 756 مكرر2 إلى 722 من القانون المدني، وأيضا بموجب المرسوم 14-99 المعنون بإدارة وتسيير البناية أو مجموع البنايات ، وذلك بإحداث هيئتين، الجمعية العامة والتي تتكون من الشركاء في الملكية أو الشاغلين لها، تقوم باتخاذ القرارات عن طريق الأغلبية، والمتصرف كهيئة تنفيذية يقوم بتنفيذ القرارات المتخذة من طرف الجمعية العامة، كما خصصنا المبحث الثاني إلى أحكام الحائط المشترك من خلال تبيان الروابط لاستعماله وحدود التصرف فيه.When freeze the Ownership in indivision، and banned the co-owners to use or benefit from it as mentioned in ‘’ mandatory indivision’’ ،to avoid any conflict between them ،and give each co-owners to exercise his rights in his part. This research focused to clarify the Provisions related the mandatory indivision That legalized by the Algerian Civil Code، which are represented in: "the common parts of the ownership of the classes"، and "the common wall". On this basis، the research was divided into two chapters، the first one explained the concept of the mandatory indivision and identified his kinds ، and the second one touched the rulings of mandatory indivision as well as its forms. 722 of the Civil Code، and also by virtue of Decree 14-99 entitled the management and management of the building or the totality of buildings، by creating two bodies، the General Assembly، which consists of the owners or occupants of it، that takes decisions by the majority، and the ‏‏'administrateur en tant qu'organe exécutif exécute les décisions prises par le parti de l'Assemblée générale، et nous avons consacré le deuxième thème aux dispositions du mur mitoyen en montrant les liens avec son utilisation et les limites de son disposition‏‏.
