مظاهر النقد الفقهي عند المفسرين المالكيين الجزائريين - تفسير الإمام الثعالبي الجواهر الحسان أنموذجا-

Résumé: تتعرض هذه الدراسة إلى موضوع مهم من الموضوعات المتعلقة بعلم الفقه، وهو النقد الفقهي عند علماء المدرسة المالكية التي تميزت بكثير من الخصائص العلمية والمنهجية في الكشف عن أحكام الشارع الحكيم من مختلف النصوص الشرعية وطريقة الاستدلال بها، وعملية النقد الفقهي هذه تعد من العمليات الضرورية في علم الفقه لما لها من دور كبير في تخليص أبواب الفقه من كثرة الآراء وتفريعاتها من خلال اختيار امثل الآراء المستندة للدلائل والحجج القوية؛ وقد ركزت هذه الدراسة على أحد أعلام المدرسة المغاربية التفسيرية الجزائرية، وهو الإمام الثعالبي في تفسيره الجواهر الحسان؛ ومن أهم النتائج التي توصلنا إليها من خلال تفسير الإمام أنه كان يعنى بالنقد الفقهي، الذي تجلت لنا مظاهره فيما يأتي: - تحرير مسائل الفقه قبل ترجيح أصوب الأقوال. - الاستدلال بالنصوص على أرجح الأقوال الفقهية من القرآن والحديث وأقوال الصحابة This study deals with an important subject related to the science of jurisprudence, which is the jurisprudential criticism of the scholars of the Maliki school, which was characterized by many scientific and methodological characteristics in revealing the rulings of the wise street from the various legal texts and the method of inference with them, and this process of jurisprudential criticism is one of the necessary processes in the science Jurisprudence because of its great role in ridding the chapters of jurisprudence from the large number of opinions and their ramifications by choosing the best opinions based on strong evidence and arguments; This study focused on one of the prominent figures of the Algerian exegetical Maghreb school, which is Imam Tha'alabi in his interpretation of Al-Jawaher Al-Hassan.
