Résumé: ومن المثير للاهتمام أن القرار الإداري هو أحد الأدوات القانونية الرئيسية التي من خلالها تقوم الإدارة بأداء واجباتها ووظائفها بكفاءة لتحقيق المصلحة العامة وخدمة الأفراد. ولصلاحية القرار الإداري حد، وبعده يتوقف القرار عن أن يكون له أثر. وهذا يعني المرحلة الختامية في عمر القرار الإداري، والمعروفة باسم نهاية القرار الإداري. 1. ينتهي القرار الإداري بالمراحل التالية، والتي سنذكرها بإيجاز: - نهاية طبيعية، إما بتنفيذ القرار الإداري، أو انقضاء مدته المحددة، أو بوقف القرار بناءً على شرط. 2. يمكن أن ينتهي القرار الإداري أيضًا لأسباب خارجة عن سيطرة الإدارة، مثل تغيير الظروف القانونية والواقعية بشكل كبير والتي أدت إلى إصدار القرار. 3. يعتبر التخلي والإهمال أيضًا من الأسباب المعقولة التي تؤدي إلى انتهاء القرار الإداري. 4. يمكن أن ينتهي القرار الإداري بالتدخل القضائي من خلال دعوى الإبطال. هذا النوع من الدعاوى، والذي له شروط وخصائص محددة، يرفعه عادة الطرف المتضرر للطعن في القرار الإداري أمام الجهات القضائية المختصة. 5. وأخيراً، يمكن أن ينتهي القرار الإداري بالتدخل الإداري، إما بسحب القرار فوراً أو بإلغائه. ومن الجدير بالذكر أن سحب القرار الإداري وإلغائه من أهم الوسائل القانونية لإنهائه. فالسحب يبطل كلياً القرارات الإدارية المعيبة وآثارها بأثر رجعي واستشرافي، في حين يبطل الإلغاء وينهي الآثار القانونية للقرار الإداري باستشرافي فقط.Interestingly, the administrative decision is one of the main legal tools through which the administration performs its duties and functions efficiently to achieve the public interest and serve individuals. This means the final stage in the life of the administrative decision, known as the end of the administrative decision. 1. The administrative decision ends with the following stages, which we will mention briefly: - A natural end, either by implementing the administrative decision, or the expiration of its specified period, or by suspending the decision based on a condition. 2. The administrative decision can also end for reasons beyond the control of the administration, such as a significant change in the legal and factual circumstances that led to the issuance of the decision. 3. Abandonment and neglect are also reasonable reasons that lead to the end of the administrative decision. 4. The administrative decision can end through judicial intervention through a nullification suit. This type of suit, which has specific conditions and characteristics, is usually filed by the affected party to challenge the administrative decision before the competent judicial authorities. 5. Finally, the administrative decision can be terminated through administrative intervention, either by withdrawing the decision immediately or by cancelling it. It is worth noting that withdrawing and cancelling the administrative decision is one of the most important legal means of ending it, as withdrawal completely nullifies defective administrative decisions and their effects retroactively and prospectively, while cancellation nullifies and ends the legal effects of the administrative decision prospectively only.
