الأساس الموضوعي والقانوني للجريمة المنظمة وتداعياتها على الأمن الدولي والوطني

Résumé: الملخص: أضحت الجريمة المنظمة من اهتمامات المجتمع الدولي نظراً لتصاعد وتيرة خطورتها على الأمن الدولي والوطني على حد سواء، خصوصا بعدما برزت وسائل جديدة في صالح المجرمين سمحت لهم باقتراف جرائمهم بصفة مريحة والوصول إلى الأهداف المتوخاة. ولهذا السبب، فإن المجتمع الدولي وأمام التصاعد الخطير الذي عرفته الجريمة المنظمة عبر العالم دفعت به لدق ناقوس الخطر ضد هذه الظاهرة التي ما فتئت أن تتوسع بأشكال وأنماط مختلفة وتحت تسميات عديدة مثل الجريمة المنظمة، الجريمة العابرة للقارات، الجريمة العالمية. سنحاول في هذه الدراسة البحث عن الأساس الموضوعي والقانوني للجريمة المنظمة وإبراز مختلف تداعياتها على المجتمع الدولي عموماً وعلى الأمن الوطني على وجه التحديد. Abstract: Organized crime has become a concern of the international community due to the growing seriousness of its threat to international and national security, especially after new avenues have been opened up for criminals, enabling them to commit their crimes comfortably and achieve the desired goals. It is for this reason that the international community faced with the dangerous escalation of organized crime in the world, has sounded the alarm against this phenomenon, which has spread in various forms and styles under many names such as organized crime, intercontinental crime and world crime. In this study, we will try to seek the objective and legal foundations of organized crime and to highlight its various implications for the international community in general and national security in particular.
