إعادة تكييف الوقائع الجزائية بين سلطة النص القانوني و سلطة حق الدفاع

Résumé: الملخص: يلتزم القاضي الجنائي بمبدأ المحاكمة العادلة والضمانات القانونية والقضائية التي تنص عليها قوانينه والاتفاقيات الوطنية والدولية والإقليمية في مجال حقوق الإنسان، والتي بموجبها يحاكم القاضي الجنائي الأطراف بناء على الوقائع المادية المحالة إليه. من قبل الطرف المتهم أو من خلال الوقائع التي ذكرها المدعي الشخصي. ويبدو أنه يتجاوز ذلك ويعيد توصيف الوقائع المنسوبة إليه بموجب السلطة القانونية التي يمنحها له القانون، ويضيف إليها سلطته التقديرية، ويعدل التهمة بما يراه مناسبا لتحقيق العدالة والحقيقة، لكن ذلك قد يخل بالدفاع. حقوق الطرفين سواء المتهم أو المجني عليه ويسبب مشاكل في الأحكام التي يصدرها في حقهما الكلمات المفتاحية: التكييف ، القاضي الجزائي ، حق الدفاع، المحكمة العليا Abstract: The criminal judge adheres to the principle of fair trial and the legal and judicial guarantees stipulated by his national laws and international and regional conventions in the field of human rights, according to which the criminal judge tries the parties based on the material facts referred to him by the accusing party or by the facts listed by the civil party. He appears to go beyond this and recharacterise the facts attributed to him under the legal authority granted to him by law, to which he adds his discretionary power, modifying the charge as he deems appropriate to reach justice and truth, but this may prejudice the defence rights of both parties, whether the accused or the victim, and cause issues in the judgments he issues towards them.
