مبدأ الثبات التشريعي وآثره في استقطاب الاستثمارات الأجنبية

Résumé: ملخص: المشرع الجزائري وفي سبيل استقطاب الاستثمارات الأجنبية وتشجيعها وحمايتها، جاء بمجموعة من الضمانات والتحفيزات القانونية، أهمها مبدأ الثبات التشريعي أو ما يعرف بشرط الاستقرار التشريعي الذي من خلاله تلتزم الدولة بعدم إدخال تعديلات على النصوص التشريعية والتنظيمية التي تحكم عقود الاستثمار المبرمة مع المستثمر الأجنبي. فمبدأ الثبات التشريعي عبارة عن مبدأ ضمان كرسته الدولة في نصوصها القانونية والاتفاقية الدولية من أجل تشجيع وجلب الاستثمارات الأجنبية، كما أن الطرف الأجنبي المتعاقد مع الدولة يسعى هو الآخر إلى ضرورة وجود هذا المبدأ في العقد تجنبا للمخاطر التي تنجم عن التغييرات التشريعية التي تحصل داخل الدولة المضيفة والتي قد تضر بمصالحه Abstract: The Algerian legislator, in order to attract, encourage and protect foreign investments, came with a set of legal guarantees and incentives, the most important of which is the principle of legislative stability, or what is known as the legislative stability condition, through which the state is obligated not to introduce amendments to the legislative and regulatory texts that govern investment contracts concluded with the foreign investor. The principle of legislative stability is a guarantee principle that the state has enshrined in its legal texts and the international agreement in order to encourage and attract foreign investments, and the foreign contracting party also seeks to have this principle in the contract in order to avoid the risks that result from the legislative changes that occur within the host country. Which may harm his interests.
