قراءة في نص المادة 88 من المرسوم الرئاسي 15/247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام

Résumé: كرّست المادة 88 من المرسوم الرئاسي رقم 15-247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام مدونة أخلاقيات المهنة خاصة بالأعوان العموميين المتدخلين في مجال الصفقات العمومية وتفويضات المرفق العام. إن تحليل هذه المادة يقتضي معالجة مضمونها بالتطرق إلى مدونة أخلاقيات المهنة الخاصة بالأعوان العمومين المذكورين من حيث كيفية إنشائها، الأعوان العمومين الخاضعين لها، مدى إلزاميتها، كيفية الالتزام بها، ثم إلى دورها في إيجاد الرقابة الذاتية لدى الأعوان العموميين المعنيين ومكافحة الفساد في مجال الصفقات العمومية. وأخيرا نستعرض بعض الملاحظات والاستنتاجات حول الموضوع، وبعض الاقتراحات التي يمكن أن تسهم في تفعيل مدونة أخلاقيات المهنة الخاصة بالأعوان العمومين المكلفين بالصفقات العمومية وتفويضات المرفق العام. Article 88 of the presidential decree no. 15-247 on the regulation of public transactions and public services delegations enshrines the code of ethics for public officials in charge of the public transactions and public services delegations. The analysis of this article requires addressing its substance related to the code of ethics for public officials listed: how to create one, public officials subjected to it, compliance with them, their role in self-censorship for public officials and combating corruption in the area of public transactions. Finally, we review a few observations and conclusions on the topic, and some suggestions that can contribute to operationalize the code of ethics for public officials in charge of the public transactions and public services delegations.
