الحق في الخصوصية الرقمية

Résumé: في هذه الورقة البحثية نحاول تسليط الضوء على مختلف التغييرات التي لحقت بمفهوم الحياة الخاصة وظهور ما أصبح يطلق عليه بالخصوصية الرقمية، فقد أصبحت الخصوصية مهددة بالاختراق والانتهاك بشكل متزايد في الآونة الأخيرة خاصة مع التطور التكنولوجي الذي استطاع الولوج إلى كافة أوجه الحياة الخاصة بالأفراد. مما استعى بذل الكثير من الجهود سواء على المستوى الدولي من خلال الاتفاقيات ومختلف المواثيق أو على مستوى التشريعات الداخلية، بما يتماشى وحماية حق الخصوصية في المجال الإلكتروني أو استحداث تشريعات خاصة تغطي هذه الحماية. In this research paper, we try to shed light on the various changes in the concept of private life and the emergence of what has become called digital privacy, as privacy has become increasingly threatened by penetration and violation in recent times, especially with the technological development that has been able to access all aspects of individuals’ lives. This has necessitated many efforts, whether at the international level, through agreements and various charters, or at the level of internal legislation, in line with protecting the right to privacy in the electronic field, or the development of special legislation covering this protection.
