القمع الجزائي كآلية لمكافحة جريمة استغلال معلومات امتيازية في سوق الأوراق المالية (دراسة مقارنة بين التشريع الجزائري و الفرنسي)

Résumé: إن حسن سير أداء سوق الأوراق المالية، مرهون بمدى قدرتها على احترام مبدأ الشفافية والإفصاح من حيث حصول جمهور المستثمرين على المعلومة الامتيازية ذات الصلة بالأوراق المالية على قدم المساواة، باعتبارها الركيزة الأساسية التي يستندون عليها في اتخاذ قراراتهم من عدمها في البيع والشراء للأوراق المالية، لما تلعبه من دور حاسم في التأثير الجوهري على انخفاض وارتفاع أسعار الأوراق المالية، فالكشف غير القانوني والاستغلال لهذه المعلومة يؤدي إلى انتهاك شفافية السوق واختلال موازينها، مما اقتضى على المشرع الجزائري التدخل حاذيا في ذلك حذو أغلب التشريعات المقارنة المنظمة لسوق الأوراق المالية، لاسيما منها التشريع الفرنسي، بوضع قوانين تجرم كل أشكال التجاوز والاستغلال المنبثق من المطلعين عليها حماية للسوق و المستثمرين فيها. The proper functioning of the stock market depends on its ability to respect the principle of transparency and information in terms of investors' access to inside information relating to transferable securities on an equal footing, since this is the main pillar on which they rely on to make their decisions to buy or sell securities, as it plays a crucial role in the fundamental impact on the fall and rise of stock prices. The illegal disclosure and exploitation of this information leads to a violation of transparency and imbalances in the market, which required the Algerian legislator to intervene, like most comparative legislation regulating the stock market, in particular French legislation. , by enacting laws criminalizing all forms of abuse and exploitation by those who know them, in order to protect the market and its investors.
