المنــازعات المترتبة على شهــادة الحيــازة

Résumé: من أجل توسيع ونجاح مجال إعادة تنظيم الممتلكات العقارية الخاصة، لجأ المشرع الجزائري الى منح سند حيازي يسمى شهادة حيازة للمواطنين الذين يحوزون على أراضي بالمناطق التي لم تشملها بعد عملية المسح العقاري وهذا وفقا للقانون 90-25 المتضمن التوجيه العقاري. ولقد منح المشرع الجزائري حماية قانونية للحائز في حالة تعرض حيازته للاعتداء، ولقد عزز المشرع الجزائري هذه الحماية الخاصة بالحيازة عن طريق رفع دعوى الحيازة أمام القاضي العقاري أو القاضي الاداري، كما مكنه المشرع اللجوء في حالات معينة للقاضي الجزائي. وتعد هذه الدعوى من الدعاوى التي يرفعها الحائز الذي فقد حيازته على العقار أو الحق العيني العقاري بالكامل، فيكتفي الحائز رافع الدعوى بإثبات حيازته لهذا الحق، وتتميز دعاوى الحيازة عن غيرها من الدعاوى بأنها دعوى وقتية ولها شروط لقيامها ولصحتها. Abstract For the expanded and success of reorganizing private landed property scope, the Algerian legislature resorted to give a possession title that is named as the possession certificate for citizens for whom possess lands in areas that it hasn’t been included in the cadastral surveys, according to the law number 90-25 containing the real estate guidance. The Algerian legislature gives a legal protection to the possessor, in case he faced a status of possession assaulting, and the legislature reinforces the expropriation protection by bringing a case in front of the real-estate judge or administrative judge, more over the Algerian legislature has enabled him to bring the case in front of the penal judge This action is considered from one of the cases that is taken by the possessor who lost possession of the property, or lost his full real estate right in rem For that the holder of the case merely proves that he possesses this right, possession cases is distincted from other cases that is a temporal case and has special conditions for their existence and validity . .
