The Administration’s Refusal To Implement Administrative Judicial Rulings Between The Legal Authority And The Administrative Judge’s Confrontation With It
Résumé: يقال "ان الدعوى تربح مرتين المرة الاولى امام القضاء ومرة اثناء التنفيذ، فنجاح القضاء يقاس بمدى تنفيذ احكامه"، لذا تتخذ الادارة عدة صور او حججا للامتناع عن تنفيذ الحكم القضائي الاداري، ولكن في مقابل ذلك فقد حاول المشرع ايجاد طرق ووسائل من اجل اجبار الادارة على تنفيذ هذا الحكم القضائي الاداري. لهذا يثار التساؤل في مدى سلطة القاضي الاداري في التدخل لكفالة تنفيذ الحكم القضائي الاداري، واذا كانت مهمته تنتهي عند حدّ اصدار هذا الحكم القضائي، ام اعتبار ان عدم تنفيذه امر راجع الى الادارة فقط باعتبارها المسؤولة الوحيدة عن هذا التنفيذ. Abstract: The administration takes several forms or arguments to refrain from implementing the administrative judicial ruling, but in return for this, the Algerian legislator tried to find ways or means to prevent non-implementation. However, a question arises about the extent of the administrative judge’s authority to intervene to ensure the implementation of administrative judicial rulings, and whether his task ends at the point of issuing this judicial ruling, or whether the failure to implement it is a matter for the administration as it is the only responsible for this implementation
