مجلس الأمن وعلاقته باختصاص المحكمة الجنائية الدولية بين التفعيل والتسييس

Résumé: يعد وجود المحكمة الجنائية الدولية كجهاز قضائي دولي دائم تطورا في مجال حماية حقوق الانسان من الانتهاكات الخطيرة التي تتعرض لها، وذلك نظر للانتقادات التي وجهت للمحاكم الجنائية الدولية المؤقتة سواء العسكرية أو الخاصة ، ولتفعيل هذه لحماية أكثر منح نظام روما الاساسي المنشئ للمحكمة دور لمجلس الامن من خلال المادتين 13-16 منه يمارس بموجبهما سلطتي الاحالة والارجاء الامر الذي آثار حفيظة بعض الدول التي رأت أنه يعرقل اختصاص المحكمة ويؤثر على استقلالها. The existence of the International Criminal Court as a permanent international judicial body is considered as an advancement in the field of human rights protection from the serious violations that they are exposed to; given the criticism leveled at the temporary International Criminal Courts, whether military or special. In order to activate this for more protection, the Rome Statute, which established the Court, granted the Security Council a role through Articles 13-16 of it, under which it exercises the powers of referral and deferment, which angered some countries, which saw it as impeding the jurisdiction of the Court and affecting its independence
