المسؤولية الجنائية للطبيب عن الأخطاء الطبية

Résumé: الملخص: تعد مهنة الطب مهنة نبيلة إنسانية وأخلاقية، لكن إساءة توظيفها يترتب عنها الخطأ الطبي الذي يمس مباشرة بحياة الإنسان،فالطبيب سواء كان في مؤسسة استشفائية عمومية أو في عيادته الخاصة مهمته تكمن في أداء واجبه وهو السهر على توجيه ووصف وتقديم العلاج للمريض ليخفف عنه معاناة مرضه، لا لأن يخطأ في علاجه أو تشخيص مرضه ووصف أدوية تؤثر على صحته، وعليه فالطبيب المرتكبلأخطاء طبية تسبب للمريض مضاعفات تؤدي بحياته للتهلكة وحتى للموت، ستقع عليه المسؤولية الجنائية عن الأعمال التي لها مساس بصحة وسلامة الجسم البشري وفقا للقوانين الوضعية التي يكون الهدف منها الحفاظ على مهنة الطب لا لعقابه لمجرد العقاب. الكلمات المفتاحية: الطبيب، العلاج، الخطأ الطبي، المريض، المسؤولبة الجنائية. Abstract : The medical profession is a noble humane and ethical profession , but its misuse results in a medical error that directly affects human life. The doctor , whether he is in a public hospital institution or in his private clinic his task lies in performing his duty, which is to ensure that the patient is directed, described and provided treatment to alleviate the suffering of his illness. Not because he makes a mistake in treating him or diagnosing his illness and prescribing medications that affect his health. Therefore the doctor who commits medical errors that cause the patient complications that lead to his life to death and even death, he will be held criminally responsible for actions that affect the health and safety of the human body in accordance with the positive laws whose goal is to preserve a profession medicine is not for scorpions, just for punishment.
