جريمة إزاحة التدابير التكنولوجية المستعملة لحماية حقوق الملكية الفكرية في البيئة الرقمية Offense Of Removal Of Technological Measures For Violation Of Intellectual Property Rights In The Environment

Résumé: الملخص: تعتبر التدابير التكنولوجية (النظام الالكتروني لإدارة حقوق المؤلف، التوقيع الرقمي،التشفير، العلامة المائية الرقمية، معرف المواد الرقمية (DOI) ,...) ,ذات أهمية كبيرة للمؤلفين لحماية مصنفاتهم الرقمية نتيجة تعرضهم للمساس بها (الجريمة الالكترونية ) . هذه التدابير أقرتها معاهدتا الويبو 1996 (معاهدتا الانترنت) في مادتها الحادية عشر 11 ويسمى المستوى الثالث للحماية (خط الدفاع الثالث ),أي مطالبة الدول المصادقة على هذه المعاهدة إقرار حماية قانونية لهذه التدابير التكنولوجية . هذه الحماية للتدابير التكنولوجية في كثير من الأحيان يكون مبالغا فيها وتمس بحقوق المؤلف التي أصبحت من الملك العام أو الحالات الاستثنائية التي ترد على الحقوق (النسخة الخاصة مثلا) , تلك هي الآثار السيئة للتدابير التكنولوجية. Abstract : Technological measures (electronic copyright management system, digital signature, encryption, digital watermark, digital materials identifier (DOI), etc.) are of great importance to authors for the protection of their digital classifiers as a result of being compromised (electronic crime). These measures were approved by the WIPO Treaties of 1996 (Internet Treaties) in its Article 11 and are called the third level of protection (third line of defense), i.e., requiring States ratifying this Treaty to establish legal protection for these technological measures. Such protection of technological measures is often overstated and affects the author's rights that have become public property or exceptional cases that are refunded to rights (e.g., a special version), such as the poor effects of technological measures.
