الحماية القانونية لعقود التجارة الالكترونية و القانون الواجب التطبيق The Legal Protection Of E-commerce Contracts And The Applicable Law

Résumé: ملخص: إن التطور الهائل و الكبير الذي تشهده التجارة الالكترونية عامة و عقود التجارة الالكترونية خاصة يعتبر تحصيل حاصل للتطور الكبير و المستمر الذي شهدته و سائل و تكنولوجيات الاتصال والمعلومات حيث أدى هذا التطور إلى بذل الجهود من طرف الفقهاء و القضاء خاصة في مجال التجارة الدولية من أجل تفسير النصوص القانونية التقليدية الموجودة ذلك بغية توفير حماية قانونية كافيةلاطراف عقد التجارة الالكترونية تشمل كل مراحل العقد و كذلك الاجتهاد في تحديد القانون الواجب التطبيق من خلال تطبيق قواعد الاسناد التقليدية وصولا الى القواعد المادية للتجارة الالكترونية. Abstract : The huge and great development witnessed by e-commerce in general and e-commerce contracts in particular is considered as a result of the continuous great development witnessed by the means and technologies of communication and information , as this development led to efforts by jurists and judges in the field of international trade to interpret traditional legal texts existing in order to provide sufficient legal protection for the parties of electronice commerce contract that includes all stages of th contract , as well as to determine the applicable law through the application of the rules of traditional attribution to the physical rules of electronic commerce
