المسؤوليّة الدستورية لرئيس الدولة في النظامين السياسيين الجزائري والأمريكي

Résumé: أقرّ المشرّع الدستوري الجزائري بمسؤوليّة رئيس الجمهورية بسبب الخيانة العظمى في دستور 1966 على غرار المشرّع الفرنسي، وكذلك المشرّع الدستوري الأمريكي الذي جعل من الإتهام الجنائي (l’impeachment) آلية لتحريك مسؤوليّة الرئيس الأمريكي، إلاّ أنّ الفراغ التشريعي والغموض والعرف الدستوري وعقبات أخرى جعلت من المسؤولية الرئاسية فرضيّة على حدّ تعبير الفقه الدستوري تحتاج إلى أطر قانونية لتفعيلها وجعلها أداة لتوازن المؤسّسات وضمانة لاستقرار النظام السياسي، وعليه كان هذا البحث من أجل تحديد الآليات الدستورية لمسؤوليّة رئيس الجمهورية في دستوري الجزائر والولايات المتحدة الأمريكية، وتحديد صعوبات تطبيقها والحلول العملية لها. Abstract: The Algerian Constitutional legislator like the French legislator approved the responsibility of the President of the Republic because of high treason in the 1996 Constitution. As well as the American constitutional legislator who made the impeachment as a mechanism to move the responsibility of US President. However, the legislative vacuum, ambiguity, constitutional custom and other obstacles made the presidential responsibility a hypothesis, in the words of constitutional jurisprudence, needs legal frameworks to activate and make it a tool to balance institutions and a guarantee for the stability of the political system. Accordingly, this research was performed in order to determine the constitutional mechanisms for the responsibility of the President of the Republic in the constitution of Algeria and the United States of America and to identify their application difficulties and practical solutions to them.
