آليات حماية حقوق الإنسان في منظومة الأمم المتحدة

Résumé: بدأت حركة تجميع وتقنين حقوق الإنسان عالميا مع جيل الحرب العالمية الثانية وبالتحديد مع نشأة منظمة الأمم المتحدة سنة 1945 التي أعطى ميثاقها لأول مرة قيمة عالمية لمبادئ حقوق الإنسان وشدد على العلاقة الوثيقة بينها وبين صون السلم والأمن الدوليين، وتعزيز التنمية الاجتماعية والاقتصادية. وبعد تبني الجمعية العامة للأمم المتحدة الإعلان العالمي لحقوق الإنسان في 10 ديسمبر 1948، أصبحت هذه الحقوق تتطور وتتقدم على مستويين: على الصعيد الإقليمي من خلال وجود ثلاثة أنظمة للحماية تتمثل في النظام الأوروبي والأمريكي والإفريقي لحماية حقوق الإنسان. أما على الصعيد العالمي فهناك شبكة ضخمة ومعقدة من الهيئات والإجراءات سواء داخل منظمة الأمم المتحدة لحماية حقوق الإنسان، أو داخل الوكالات المتخصصة التي طورت آليات خاصة لبعض حقوق الانسان التي تدخل في نطاق اختصاصها. وعليه تناولت هذه الدراسة إشكالية مدى حماية حقوق الإنسان من خلال الوسائل التي رصدتها الاتفاقيات الدولية لمراقبة احترام الدول لتعهداتها والتزاماتها الدولية، وما دور هذه الآليات المستحدثة سواء بموجب المعاهدات الدولية أو بموجب أجهزة منظمة الأمم المتحدة في تعزيز هذه الحماية؟ Abstract: The movement of collecting and codifying human rights began globally with the generation of World War II, and specifically with the establishment of the United Nations in 1945, whose charter for the first time gave universal value to the principles of human rights and emphasized the close relationship between them and the maintenance of international peace and security, and the promotion of social development and economic. After the adoption of the Universal Declaration of Human Rights by the United Nations General Assembly on December 10, 1948, these rights On the global level, there is a huge and complex network of bodies and procedures, whether within the United Nations Organization for the Protection of Human Rights, or within the specialized agencies that have developed special mechanisms for some human rights that fall within the scope of their competence. Accordingly, this study addressed the problem of the extent to which human rights are protected through the means monitored by international conventions to monitor states’ respect for their international commitments and obligations, and what is the role of these new mechanisms, whether under international treaties or under the organs of the United Nations Organization, in strengthening this protection?
