الأوامر التشريعية ومبدأ سيطرة البرلمان - دراسة في الأساس القانوني للتشريع بأوامر

Résumé: إذا كان الأصل أن التشريع هو اختصاص أصيل للبرلمان وهذا استنادا إلى مبدأ هام من المبادئ التي يقوم عليها القانون الدستوري وهو مبدأ سيطرة البرلمان، إلا أن هذا المبدأ ورد عليه استثناء إذ بإمكان رئيس الجمهورية أن يتدخل في المجال التشريعي العائد للبرلمان وذلك بموجب أوامر وهذا استنادا إلى نظرية الظروف الإستثنائية. Abstract: The asset was that legislation is the inherent jurisdiction of the Parliament and this on the basis of an important principle of the principles underlying the constitutional law. A principle which controls the parliament, however, there is an exception, in which the President can intervene in the legislative field that is returned to parliament, under orders, and this on the basis of the exceptional circumstances theory.
