إشكالات تحقيق المناط في العملات الرقمية المشفرة، دراسة فقهية اقتصادية

Résumé: ملخص: غيُر خافٍ أن الصناعة المالية والمصرفية تعتمد في جوهرها على قطاع الدفع وتحويل الأموال من خلال تطوير أنظمة الدفع، وتحسين أداء الخدمات المالية، ولكن بميلاد العملات الرقمية المعمّاة (المشفرة)، كالبيتكوين وغيرها من العملات، استطاعت أن تفرض وجودها كوسيط للتبادل الحر، متجاوزة سلطات الدول ومركزية السلطة النقدية والمالية. ونهدف من هذه الدراسة بحث إشكالات تتعلق بتحقيق المناط في النقود الرقمية المشفرة، وفق المفهوم الفقهي المتعلق بالنقود، فهل تنطبق عليها العلل المعتبرة كالنقدية أو المالية أو هي شبه بينهما، أو أنها من قبيل السلعية والأصول. ولتحقيق أهداف البحث واختبار فروضه، كان لزاما اخضاعه لقواعد المنهج العملي المعتبر، فاعتمدنا على المنهج الوصفي في عرض ماهية النقود والعملات الرقمية وخصائصها، ثم المنهج التحليلي والاستدلالي بغرض تحليل مضامين العلل الشرعية للعملات الرقمية قدر الإمكان. ولقد توصل الباحث إلى نتائج منها: صعوبة ضبط العلية في العملات الرقمية المشفرة ، والأمر فيه احتياط في الإعمال لأنه لم يستقر وضعه في الدرس الاقتصادي والمالي، والقول بوحدة المناط فيها وتحققه لا يكاد يسلم من اعتراض أو قوادح في أحكامها، على أنه وإن لم يمكن القول بنقديتها مطلقا فلا مناص من اعتبار وصف المالية فيها تحقيقا لمصالح الأنام، وتشوفا لمقاصد الشارع فيما يتعلق بها من أحكام. الكلمات المفتاحية: النقودـ، العملات، المالية، البتكوين، العلل، الشريعة Abstract : It is no secret that the financial and banking industry depends in essence on the payment and money transfer sector through the development of payment systems and improving the performance of financial services, but with the birth of cryptocurrency (encrypted) digital currencies, such as Bitcoin and other currencies, it was able to impose its presence as a medium of free exchange, bypassing the authorities of countries centralization of monetary and fiscal authority. We aim from this study to examine problems related to the realization of what is entrusted with encrypted digital money, according to the jurisprudential concept related to money, so do the considered causes such as cash or financial or are similar between them, or are they like commodities and assets. To achieve the objectives of the research and test its hypotheses, it was necessary to subject it to the rules of the considered practical approach, so we relied on the descriptive approach in presenting the nature of money and digital currencies and their characteristics, then the analytical and inferential approach in order to analyze the contents of the legitimate causes of digital currencies as much as possible. The researcher has reached results, including the difficulty of controlling the attic in encrypted digital currencies, and the matter is a precaution in the work because it has not settled its position in the economic and financial lesson, and the statement of the unity entrusted with it and its realization is hardly safe from objection or quarrels in its provisions, although it is not possible to say its criticism. Absolutely, it is inevitable that the description of finances in them should be considered as a realization of the interests of people, and a desire for the purposes of the Lawgiver in relation to them in terms of rulings. key words: Money, currencies, finance, bitcoin, ills, Sharia
