السجل التجاري الإلكتروني في ظل الحوكمة الإلكترونية

Résumé: الملخص: أصدر المشرع الجزائري جملة من القوانين بهدف تهيئة بيئة رقمية مُلائمة لمُمارسة التجارة الإلكترونية، لا سيما بعد صدور القانون رقم 18-05. ومن هذا المنطلق، برزت أهمية دراسة مدى تنظيم المشرع للسجل التجاري الإلكتروني، نظرًا لدوره الحيوي في الإحصاء، والإقتصاد، والإشهار. تتجلى أهمية رقمنة السجل التجاري في تعزيز موثوقية مُستخرجاته وحمايتها من التزوير، التلاعب، أو الاحتيال، كما تسهم هذه الرقمنة في تحديث آليات مُراقبة النشاطات التجارية، ضمن إطار السعي لتحقيق مشروع الحوكمة الإلكترونية الذي تهدف الجزائر إلى تجسيده، يأتي ذلك من خلال رقمنة مُختلف القطاعات، ولا سيما قطاع التجارة، بهدف القضاء على البيروقراطية في العمل الإداري وتعزيز الشفافية والوضوح في المعاملات، بما يدعم مبدأ الثقة والائتمان التجاري. Abstract: The Algerian legislator has enacted a series of laws aimed at creating a digital environment conducive to conducting e-commerce, particularly following the issuance of Law No. 18-05. This has highlighted the importance of examining the legislator's regulation of the electronic commercial register, given its crucial role in statistics, economy, and publicity. The significance of digitizing the commercial register lies in enhancing the reliability of its outputs and protecting them from forgery, manipulation, or fraud. Additionally, this digitization contributes to modernizing the mechanisms for monitoring commercial activities, as part of the effort to implement the electronic governance project that Algeria seeks to achieve. This is done by digitizing various sectors, especially the trade sector, to eliminate administrative bureaucracy and promote transparency and clarity in transactions, thereby supporting the principles of trust and commercial credit.
