النظام القانوني لجريمة رشوة الموظفين العموميين

Résumé: ملخص: تنطوي الرشوة على اتجار الموظف العام بوظيفته واستغلالها على نحو يحقق له فائدة خاصة، وهذا يؤدي إلى اختلال في ميزان القيم والعدل داخل المجتمع، ومن هنا اتجه المشرع الجزائري على غرار بقية التشريعات الجنائية الأخرى لتجريم رشوة الموظفين العموميين لما فيها من مساس بنزاهة الإدارة وإهدار للثقة التي يجب أن يوليها الأفراد للسلطة العامة، كما أنها تؤدي إلى انتفاء العدالة، وتصبح الوظيفة العامة سلعة تباع وتشترى، من هنا كان الهدف الذي نصبوا إليه من خلال هذه الدراسة هو الوقوف على المستجدات التي جاء بها قانون الوقاية من الفساد ومكافحته فيما يخص هذه الجريمة، لنصل في الأخير إلى عدة نتائج لعل أهمها وجوب إعادة النظر في العقوبات المقررة لها نظرا لخطورتها وأبعادها. كلمات مفتاحية: الفساد، الرشوة، الموظف العمومي، العقوبة. Abstract: Bribery involves the public servant trading in his job and exploiting it in a way that achieves his own benefit, and this leads to an imbalance in the balance of values and justice within society. Hence, the Algerian legislator, like the rest of the other criminal legislation, has tended to criminalize bribery of public officials because it affects the integrity of the administration and wastes the trust that it provides, individuals must entrust it to the public authority, as it leads to the absence of justice, and the public office becomes a commodity to be bought and sold. Hence, the goal they set out for through this study was to identify the developments brought by the law on prevention and combating corruption with regard to this crime, to reach in the end, it leads to several results, perhaps the most important of which is the necessity of reconsidering the penalties prescribes for it due to its gravity and dimensions.
