الحماية الجنائية للمرأة ضد العنف الزوجي حسب قانون العقوبات الجزائري

Résumé: تعد المرأة عنصرا مهما في المجتمع بل هي الأهم فيه، نظرا للدور الأساسي الذي تؤديه في تنشئة الأسرة، وبالرغم من أهمية المرأة في المجتمع إلا أنه هناك من ينظر إليها بنظرة التنمر والتمييز، بالإضافة إلى تعرضها إلى العديد من أشكال العنف، ولعل أبرزها العنف الزوجي، فظاهرة العنف الزوجي ضد المرأة تمس جميع النساء على اختلاف أعمارهن وثقافتهن وأوضاعهن الاجتماعية. تهدف هذه الدراسة إلى تسليط الضوء على الحماية الجنائية التي وفرها المشرع الجزائري للمرأة من العنف الزوجي والذي يأخذ نوعين؛ عنف مادي، وآخر معنوي، وذلك من خلال تجريم الأفعال والتصرفات التي تؤدي المرأة، وذلك للتقليل من تنامي مختلف ظواهر الإجرام في حقها. Abstract: Women are an important element in society, but rather the most important in it, given the basic role they play in raising the family, and despite the importance of women in society, there are those who view them with the view of bullying and discrimination, in addition to their exposure to many forms of violence, perhaps the most prominent of which is marital violence. The phenomenon of spousal violence against women affects all women of all ages, cultures and social statuses. This study aims to shed light on the criminal protection provided by the Algerian legislator to women from marital violence, which takes two types; Physical and moral violence, by criminalizing the actions and behaviors that lead to women, in order to reduce the growth of the various phenomena of crime against them.
