الحماية الإجرائية للحق في الخصوصية الرقمية في مواجهة الجريمة المعلوماتية

Résumé: في ظل التطور المستمر لتكنولوجيا المعلومات والاتصالات زاد الاهتمام بحماية الحق في الخصوصية في العالم الافتراضي، وعلى غرار مختلف التشريعات قد كفل المشرع الجزائري حمايته من خلال الدستور الجزائري ومختلف القوانين العقابية كما قدم حماية اجرائية له من خلال محاولته في ايجاد توازن بين تبني القواعد الاجرائية لمكافحة الجريمة المعلوماتية وبين حماية الحق في الخصوصية، وذلك بإقراره جملة من الضمانات القانونية التي من شأنها حماية هذا الحق من مختلف أشكال التعسف، في ظل كل من قانون الاجراءات الجزائية والقانون رقم 09/04 المتضمن القواعد الخاصة للوقاية من الجرائم المتصلة بتكنولوجيات الإعلام والاتصال ومكافحتها. في هذا السياق تأتي هذه الدراسة لتبحث في الموازنة بين حق الدولة في متابعة الجريمة المعلوماتية وحق الأفراد في حماية خصوصيتهم الرقمية. Abstract: The interest in protecting the right to privacy in the Virtual world has increased through the continuos development of information and communication technologies ;The Algerian legislator has also guaranteed its protection through the Algerian constitution and various penal laws, and it has provided procedural protection for it as well through its attempt to find a balance between adopting procédural rules to combat information crime and protecting the right of privacy, and under both the Criminal Procedure Law and Law No. 04/09 containing the special rules for the prevention and control of crimes related to information and communication technologies. It has approved a set of legal guarantees That will protect it from various forms of arbitrariness. For this reason, this study seeks to balance the state's right to pursue information crime and the right of individuals to protect their digital privacy
