التعويض عن الحبس المؤقت في القانون الجزائري والتشريع الفرنسي

Résumé: التعويض عن الحبس المؤقت نظمته المادة 137 مكرر من ق إج الجزائري إلى 137مكرر14 بموجب القانون 01/08 المؤرخ في 26 يونيو 2001 والذي نص على إمكانية منح تعويض لمن كان محل حبس مؤقت غير مبرر وصدر بحقه قرار بألا وجه للمتابعة، متى لحق به ضرر ثابت ومتميز. وقد حذا المشرع الجزائري حذو المشرع الفرنسي الذي نظم هذا الموضوع بالقانون رقم 643/70المؤرخ في 17/07/1970 وقد خضع النص الفرنسي لتعديلات متلاحقة كان آخرها القانون رقم1335/2000أما المشرع الجزائري فلم يساير هذه التعديلات. وهو ما سنتناوله في هذه الدراسة. The indemnity for provisional detention is governed by article 137bis to article 137bis 14 from the Algerian penal procedures law which is enacted in law No. 08/01 dated June 26th 2001 stipulating the possibility to grant an indemnity to any person who was subject to a non-justified temporary detention, which was concluded by the issuance of a final order of dismissal whenever he sustained an established, continuous and outstanding damage. The Algerian legislator followed the example of the French legislator who regulated this matter by virtue of law No. 70/643 dated July 17th 1970. The French law was subject to subsequent amendments, the last one was law No. 2000/1235. Regarding the Algerian legislator, he did not follow such amendments, and this the theme of our study.
