أثر التزامات أطراف عقد النقل البحري للبضائع على مسؤولية مقاول الشحن والتفريغ طبقا للقانون البحري الجزائري و الاتفاقيات الدولية

Résumé: عقد الشحن والتفريغ من العقود الملزمة لجانبين ينشئ التزامات متقابلة في ذمة متعاقديه، فمقاول الشحن والتفريغ يلتزم بشحن البضائع وتفريغها ،وقد يعهد إليه أعمالا قانونية متصلة بهما، في حين يلتزم المتعاقد مع المقاول بإيفائه أجره، كما قد يرتب العقد في ذمة المتعاقد مع المقاول التزامات أخرى تختلف في طبيعتها حسب الشخص المتعاقد مع المقاول سواء كان ناقلا أو شاحنا أو مرسلا إليه، وتبدو أهمية دراسة التزامات أطراف عقد النقل البحري اتجاه مقاول الشحن والتفريغ في أثرها على قيام مسؤولية هذا الأخير في حالة حصول ضرر للبضاعة نتيجة إخلال المتعاقد بالتزاماته تؤدي إلى إعفاء المقاول من المسؤولية لأن الضرر كان بسبب أجنبي. abstract :the contract of loading and unloading of goods(the harbor handling) from binding contracts to two parts, creates corresponding obligations in the custody of the contractors, the shipping and unloading contactor is obliged to load and unload the goods,and may be entrusted with other related work,while the contractor is obliged to pay the cotractor . the contract provides for other contractual obligations in the case of a contractor which vary according to nature of the person contracted with the contractor whether a carrier, a shipper or a consignee. the importance of studying the obligations of the parties to the contract of carriage in respect of the contractor because of the laibility of the latter in the event of damage resulting from the breach of the obligations of contract entails the exoneration of liabilility of the contractant because the domage results aforeigin reason .
