عقوبة الاعدام بين التنظيم والتجريم

Résumé: ملخص: إن قتل الإنسان للإنسان بكل أنواعه هو من بقايا توحش البشر، وللأسف ما زال هذا التوحش يكبل عنق الإنسان وروحه ويطبق على أذهان قسم كبير من البشرية المعاصرة، وقد ظهرت عقوبة الإعدام مع ظهور الدوله التي كانت تفرضها لتدعيم سلطته على كافة أقاليمها، وأصبح الهدف من العقوبه تأمين سلطات الدوله والمحافظة على نظام المجتمع، من خلال حكم الموت والذي يعتبرالنهاية الظالمة للحياة الإنسانية، حيث أوجدت عقوبة الإعدام تيارين كبيرين متنافرين، أحدهما يقف مع عقوبة الإعدام باعتباره عقوبة رادعة محققة لأهداف العقوبة كما في التشريعات العربية والإسلامية وبعض الدول الغربية، وطرف آخر يقف بصورة حادة ضد عقوبة الإعدام كما في أوروبا والولايات المتحدة والذين استندوا بشدة إلى ضرورة إلغاء تلك العقوبة واحترام حرية الإنسان . Abstract:Killing one another is an act of cruelty and thus there is a savage beast in every man remained from the first man. Death penalty, for example, is the ultimate cruel, inhuman and degrading punishment. Where it is a government-sanctioned practice whereby the government used to use in order to enforce its authority on its territories. Yet, the reason behind this penalty is to ensure the state’s authority and to keep order in the community; therefore, a person is killed by the state as a punishment for a crime, regardless of the fact that it is just or unjust. In fact, there has been an international debate and two opposing opinions over the death penalty. On the one hand, there are those who consider the death penalty as a preventive punishment and it achieves its goals, such as the Islamic and Arab societies. On the other hand, those who stand again this penalty and call to cancel such punishment as it contradicts with the very basic of human rights, such as the United States of America and Europe.
