دور الخبرة القضائية في دعم الاقتناع القضائي وتحقيق العدالة الجنائية

Résumé: ملخص: للخبرة القضائية أهمية بالغة في عملية الإثبات، خاصة في المجال الجنائي، فالقضاء دائما يسعى إلى تحقيق العدالة للأفراد مهما كانت القضية التي أمامه، فالمشرع أجاز له الاستعانة بأهل الخبرة من أجل دعم رأيه وقناعته، ومن خلال هذا المقال سنتعرض لمفهوم الاقتناع الشخصي للقاضي الجزائي والنتائج المترتبة عليه وكذا الخبرة القضائية وخصائصها ثم نبين مكانتها كوسيلة إثبات في المجال الجنائي وذلك بالتركيز على أهم صورها ومدى مشروعية اعتماد تقاريرها وحجيتها في تحقيق العدالة الجنائية. Abstract Judicial expertise is of great importance in the evidence process, especially in the criminal field, because the judiciary always seeks to bring justice to individuals, regardless of the case before it. It, as well as the judicial experience and its characteristics, we then show its status as a means of evidence in the penal field by focusing on its most important forms and the legality of adoption of its reports and their authority in the realization of criminal justice.: Judicial experience is very important in the prosecution process, especially in the criminal field. The judiciary always seeks to do justice to people, regardless of the dispute before it. The legislator allowed him to use his expertise to support his opinion and his conviction, and through this article we will review the concept of forensic expertise and its characteristics. And then, to show its status as a means of evidence in the criminal field by emphasizing the most important images and the legitimacy of the adoption of their reports and their legitimacy in the administration of criminal justice.
