إعفاء الإتفاقات التي تساهم في تحقيق التقدم الإقتصادي من الحظر-دراسة تحليلية في ظل أحكام قانون المنافسة-

Résumé: يحظر المشرع الجزائري الاتفاقات الصريحة أو الضمنية عندما تهدف أو يمكن أن تهدف إلى عرقلة حرية المنافسة لما لها من آثار خطيرة على المنافسة. وإذا كانت معظم تشريعات المنافسة قد قامت بمنع الممارسات المخلة بقواعد المنافسة، فإنها في ذات الوقت نصت على تبريرات أخرجت هذه الممارسات من دائرة المنع، والمشرع الجزائري بدوره لم يخرج عن هذا الاطار، إذ نص في المادة 9/2 من الأمر رقم 03-03 على نظام إعفائي يطبق على الممارسات المحظورة، ويتعلق الأمر بالاتفاقات التي من شأنها تحقيق تقدم إقتصادي، إذا ما استوفت الحالات والشروط المنصوص عليها قانونا، وهذا تحقيقا للمصلحة الاقتصادية للبلد. Prohibits the website of the Algerian agreements, express or implied, when aimed or can be aimed at obstructing the freedom of competition because of its serious effects on competition. While most competition legislation prohibits practices that violate competition rules, it also provides grounds for removing such practices from the sphere of prevention.the Algerian legislature, in turn, has not derogated from this framework. Article 9, paragraph 2, of Ordinance No. 03-03, provides for an exemption regime applicable to prohibited practices. these are agreements that, if the conditions and conditions stipulated by law are met, will bring about economic progress, in the interests of the country's economic interests.
