مكافحة الفساد في الجماعات المحلية

Résumé: إن الفساد على مستوى الجماعات المحلية يعتبر عثرة في طريق التنمية المحلية والإصلاح الإداري ، وهو الأمر الذي من شأنه التأثير بصورة مباشرة على التنمية الوطنية وفي إطار هذه الظاهرة التي تهدد كيان المجتمع المحلي، حاولنا في هذه الدراسة إبراز جل أنواع الفساد المحلي ، والأسباب المؤدية إلية والوقوف على مختلف الانعكاسات والآثار التي ترتبها هذه الظاهرة على مستوى جميع الأصعدة ، وبالمقابل قمنا بعرض الآليات القانونية التي سخرها المشرع الجزائري والآليات المؤسساتية ، حيث تتمثل الأولى في كل من قانون الوقاية من الفساد ومكافحته " قانون 06/01" وقانون الجماعات الإقليمية والذي يشمل كل من قانون الولاية "12/07 وقانون البلدية 11/10"، هذه الآليات التي كان لها الدور الفعال في التصدي لظاهرة الفساد المحلي. وفي إطار تحقيق الديمقراطية على المستوى المحلي وإعطاء البديل الناجح والمطبق على معظم الإدارات المحلية كان لابد من التطرق إلى حوكمة الإدارة المحلية ومدى مساهمة فواعلها عن طريق مؤشرات وآليات الحوكمة في محاربة الفساد المحلي – الفساد في الجماعات المحلية – من جهة، وعصرنة الإدارة المحلية وجعلها إدارة محلية الكترونية على حساب الإدارة المحلية الورقية من جهة أخرى. الكلماتالمفتاحية: الفساد في الجماعات المحلية،مكافحة الفساد ، الحوكمة المحلية . Abstract: Corruption at the level of local groups is an obstacle in the way of local development and administrative reform, which would directly affect national development and in the context of this phenomenon that threatens the entity of the local community, we exposed in this study to highlight most types of local corruption and the causes leading to it and to stand on the various the repercussions and effects of this phenomenon at all levels. On the other side, represents the legal mechanisms That the Algerian legislator harnessed and the institutional mechanisms,where the first is represented in the prevention and control of corruption law "06/01" and the law of regional communities,which includes both the state law "12/07 municipal law 11/10 these are mechanisms that had an effective role in addressing the phenomenon of local corruption. In the context of achieving democracy at the local level and giving a successful alternative applicable to most local administrations ,it was necessary to address the governance of the local administration and the extent of the contribution of its actors through government indicators and mechanisms in combating local corruption –corruption in local groups –on the one side ,and modernizing the local administration and making it an electronic local administration on the other side, at the expense of paper management.
