إصلاح نظام إفلاس الشركات التجارية - دراسة مقارنة -

Résumé: ازدادت أهمية الشركات التجارية في الحياة الاقتصادية للدول، و ازدادت معها الــــــعراقــــــيل و الصعوبــــــــات التي تصادفهـــــا في حيـــــــــاتها التجارية، نتيجة لعــــــدة عــــــــوامـــــــل و ظروف تؤثر سلبا على استمرار نشاطها و إمكانية إعلان إفلاسها في حالة عدم معالجتها. و نظرا لما للإفلاس من آثار وخيمة على المنظومة الاقتصادية و الاجتماعية لمختلف الدول، أصبح إيجاد آليات فعالة للحد من هذه الصعوبات في القانون الجزائري و المقارن ضرورة ملحة. كلمات مفتاحية: الشركات التجارية، الصعوبات، الإفلاس. The importance of commercial companies in the economic life of countries has increased. Many obstacles and difficulties encountered in their business life have increased as well. As result of several factors and conditions that adversely affect their continued activity and the possibility of declaring their bankruptcy if they are not dealt with. Inasmuch the effects of bankruptcy on the economic and social system of different states, the creation of effective mechanisms to reduce these difficulties in Algerian and comparative Law is an urgent necessity
