العقوبات البديلة كشكل من اشكال سياسة الحد من العقاب في التشريع الجزائري

Résumé: اهتمت السياسة الجنائية الحديثة بالعقوبة وخاصة بمساوئها التي أدت الى إحداث أضرار كبيرة للمجتمع والمحبوس ،وكذلك الدولة ، مما جعلها تهدف الى تطورها وذلك عن طريق تحول العدالة التقليدية الى العدالة الحديثة للحد من العقاب باستحداث العقوبات البديلة محل العقوبات الأصيلة ، وفق شروط محددة بهدف المساهمة في إصلاح وإعادة التأهيل لأن المعاملة العقابية التقليدية لم تعد كافية لتحقيقها بل زادت من نسبة الإجرام ولهذا تأثر بها المشرع الجزائري بتبنيه بعض البدائل العقابية الحديثة لأن السياسة الجنائية التقليدية الجزائرية ،أدت الى زيادة في تعدد الجرائم و وكثرة مساوئ المؤسسات العقابية ، خاصة أن المؤسسات العقابية الجزائرية تعاني من عدة سلبيات، لهذا رأى المشرع الجزائري أن استحداث العقوبات البديلة المتمثلة في وقف التنقيد و نظام الإفراج المشروط ، وكذا عقوبة العمل للنفع العام و نظام المراقبة الإلكترونية التي اعتبرها تجربة نمودجية في اصلاح المنظومة السجنية التي هدفها سياسة الحد من العقاب المتمثل في إعادة الإصلاح والتأهيل . Abstract: Modern criminal policy has been concerned with punishment, especially its disadvantages that have caused great harm to society and the prisoner, as well as the state, which made it aim to develop it by transforming traditional justice into modern justice to reduce punishment by introducing alternative penalties to replace the original punishments, according to specific conditions in order to contribute to reform And rehabilitation because the traditional punitive treatment is no longer sufficient to achieve it. Rather, it increased the crime rate, and this is why the Algerian legislator has been affected by the adoption of some modern punitive alternatives because the Algerian traditional criminal policy has led to an increase in the multiplicity of crimes and the multiplicity of the defects of penal institutions, especially that the Algerian penal institutions suffer from There are several drawbacks, and this is why the Algerian legislator saw the introduction of alternative penalties, represented in the cessation of admonishment and the conditional release system, as well as the work penalty for public benefit and the electronic monitoring system, which he considered an exemplary experiment in reforming the prison system whose aim is to reduce the punishment of reform and rehabilitation.
