تقييد المشرع الجزائري حرية الاثبات الجنائي في جريمتي الزنا و القيادة في حالة سكـر

Résumé: ملخص: الأصل أن القاضي الجزائي غير مقيد بوسيلة محددة من وسائل الاثبات، بل له أن يكون اعتقاده بثبوت الجريمة أو نفيها من خلال جميع ظروف و ملابسات الجريمة، سواء كان ذلك بالكتابة أو بأي طريقة أخرى من طرق الاثبات، كما هو الحال بالنسبة للإقرار أو شهادة الشهود أو القرائن. و إستثناءا على ذلك، ألزم المشرع الجزائري من خلال المادة 212 من قانون الاجراءات الجزائية المعدل و المتمم. إثبات بعض الجرائم بطرق محددة، لا ينبغي للقاضي الجزائي أن يكون إقتناعه بدليل من غير الدليل الذي يشترطه القانون في تلك الجريمة. و هذا ما تبناه المشرع الجزائري في جريمتي الزنا و جريمة القيادة في حالة سكر. كلمات مفتاحية: حرية الاثبات، شروط حرية الاثبات، اثبات الزنا، اثبات القيادة في حالة سكر. Abstract: The principle is that the criminal judge is not bound by a specific means of proof; rather, he can form his belief in the establishment or denial of the crime through all circumstances and details of the crime, whether it is by writing or any other method of proof, as is the case with confession, witness testimony, or circumstantial evidence. By way of exception, the Algerian legislator, through Article 212 of the amended and supplemented Code of Criminal Procedure, has mandated the proof of certain crimes by specific means, and the criminal judge should not be convinced by evidence other than that which the law requires for that crime. This is what the Algerian legislator has adopted in the crimes of adultery and driving under the influence.
