النظام الأوروبي لحماية الأطفال المهاجرين غير النظاميين

Résumé: تتضمن الدراسة مناقشة مبادئ حماية حقوق الأطفال المهاجرين غير النظاميين في النظام الأوروبي لحقوق الإنسان، وفق ما تنص عليه الصكوك العالمية لحقوق الإنسان و الاتفاقية الأوروبية لحقوق الإنسان وتوجيهات مجلس أوروبا، وبيان موقف المحكمة الأوروبية لحقوق الإنسان من التجسيد العملي لتلك الحقوق بمناسبة فصلها في بعض القضايا المتعلقة باحترام السلطات المختصة في الدول الأوروبية لحقوق الأطفال المهاجرين. و قد توصلت الدراسة إلى أن بعض القضايا التي عالجتها المحكمة الأوروبية لحقوق الإنسان كشفت أنه بالرغم من الضمانات التي يوفرها النظام الأوروبي لحقوق الإنسان لصالح حماية الأطفال المهاجرين فإن السلطات المختصة في بعض الدول الأوروبية تتمادى في انتهاك حقوق هذه الفئة الهشة من المهاجرين. The study includes the discussion of the principles of protecting the rights of irregular migrant children in the European system of human rights, as stipulated in the European Convention on Human Rights and the directives of the Council of Europe, and the position of the European Court of Human Rights on the practical embodiment of these rights In European countries for the rights of migrant children. The study found that some of the cases dealt by the European Court of Human Rights revealed that despite guarantees by the European system of human rights for the protection of migrant children, competent authorities in some European countries continue to violate the rights of this vulnerable group of migrants.
