إشكالات توثيق مشارطات الزواج المحرر من قبل الموثق

Résumé: نص المشرع الجزائري على حق الزوجين في وضع الشروط المتعلقة بالحياة الزوجية، سواء في عقد الزواج أو في عقد رسمي لاحق، بشرط ألا تخالف النظام والآداب العامة وقانون الأسرة، لكن الموثق يصادف مشاكل كبيرة في هذا الصدد بسبب كون فكرة النظام العام مرنة وغير ثابتة، يختلف فهمها من موثق لآخر حسب ثقافته وخبرته، وكذلك عدم تقيد المشرع الجزائري بمذهب معين، لأن قانون الأسرة يحيل إلى الشريعة الإسلامية عند غياب النص القانوني، لذا قد يتهرب الموثق من تحرير العقد وبالتالي قد يفوت على الطرفين فرصة الزواج، أو يكون سببا في تضييع الحقوق، كما قد يحرر عقدا بشروط تخالف القانون أو النظام العام أو الشريعة، فيصبح سببا في فسخ الزواج أو إبطاله، أو سببا في الطلاق أو التطليق أو الخلع. The Algerian legislation allows the spouses to set conditions related to marital life provided they do not violate the public order and family law, but the notary faces big problems because the idea of public order is flexible and unstable, and its understanding varies from notary to notary. According to his culture and experience as well as the failure of the Algerian legislator to adhere to a certain religious belief, and therefore the notary evades from writing the contract. This occurs through the opportunity to marry or be a cause of loss of rights or a notarized releases a contract with conditions that violate law and public order or Sharia which makes it a reason to cancel or annul the contract
