مرحلة تحديد الحاجات في الصفقات العمومية

Résumé: تناولنا في هذه الدراسة موضوعا له أهمية بالغة نظرا لحداثته وأهميته الاقتصادية يتعلق بتطبيق قانون المنافسة على الصفقات العمومية إن تطبيق قانون المنافسة على الصفقات العمومية له أثر ايجابي يكمن في ضمان نجاعة الصفقات العمومية والاستعمال الحسن للمال العام ويهدف لحماية المصلحة المتعاقدة عند بخضوعها له وحماية للمتعاملين المتعاقدين،فكل استعمال سيئ صادر عن الإدارة أو العون الاقتصادي ،كرس له المشرع آليات مؤسساتية رقابية أوكلت لها مهمة ضبط وتنظيم الصفقات العمومية ألا وهي مجلس المنافسة وسلطة ضبط الصفقات العمومية والرقابة الخارجية للصفقات ، حيث منح لهم المشرع صلاحيات واسعة لحماية المنافسة في الصفقات العمومية والمتعاملين من خلال سن جملة من القوانين رسمها كل من القانون رقم 08/12 المتعلق بالمنافسة والمرسوم الرئاسي رقم 5/247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام بهدف متابعة كل ما يمس من ممارسات مقيدة ومنافية للمنافسة في مجال الصفقات العمومية. Abstract: In This study ,we dealt with a topic of great importance due to its modernity and economic importance related to the application of the competition law to public transactions ,for every misuse issued by the administration or economic aid,the Algerian legislator worked to establish supervisory institutional mechanisms entrusted with the task of controlling and regulating public transactions,namely , the Competition Council, the authority to control public transactions, and external control of transactions and transactions through the enactment of a set of laws drawn up by each from Ordinance 08/12 relating to competition and Presidential Decree N°15/247 relating to the organization of public procurement and public utility authorizations with the aim of following up on all that affects the restrictive and anti-competitive practices in the field of public procurement .
