دعوى الإثراء بلا سبب آلية لحماية سرية المعرفة الفنية في مرحلة المفاوضات

Résumé: الملخص: تعتبر خاصية السرية في المعرفة الفنية، من أبرز المواضيع التي يهتم بها أطراف عقود نقل المعرفة الفنية، خاصة في مرحلة المفاوضات وهذا نظرا لتعارض المصالح بين الأطراف، إذ يحرص المانح على اتخاذ كافة التدابير لحماية سرية معرفته الفنية، في الوقت الذي يسعى فيه المتلقي إلى الاطلاع على مضمون هذه المعرفة للوقوف على مدى أهميتها التجارية والاقتصادية ما يجعله يلتزم بالمحافظة على سرية ما اطلع عليه أثناء التفاوض، فإذا ما أخل بهذا الالتزام وأفشى سرية المعرفة الفنية، يمكن للمانح رفع دعوى الإثراء بلا سبب لجبر الضرر الذي لحقه نتيجة ذلك، إذا ما توافرت شروط هذه الدعوى . Abstract: The property of confidentiality in artistical knowledge is one of the most important topics that the parties to artistical knowledge transfer contracts are concerned with, especially in the negotiations, due to the conflict of interests between the parties, as the donor is keen to take all necessary measures to protect the confidentiality of his artistical knowledge , while the recipient seeks to access the content of it to determine the extent importance, that makes him obligated to maintain the confidentiality of what he learned during the negotiation, if he breaches this obligation the donor may file acase for enrichment without reason to redress the damage he suffered as a result if the conditions of his claim are met.
